General Terms and Conditions (GTC)

 

Scope of Application

These General Terms and Conditions (GTC) apply to all services provided by Funke Center in the areas of psychological diagnostics, psychotherapy pursuant to the German Heilpraktikergesetz (HeilprG), parent training, parent–child interaction guidance, and related healthcare services. They apply in addition to the individually concluded treatment agreement.

 

Nature of the Services

Funke Center (practitioner: Eldin Dzanko) provides healthcare services in accordance with the German Heilpraktikergesetz (HeilprG). The services include, in particular, psychotherapeutic interventions, psychological diagnostics, parent-based interventions, and the preparation of written psychological reports. The specific scope and form of services are determined by individual needs and regulated in the treatment agreement. No specific therapeutic outcome is owed.

 

Delimitation and No Promise of Cure

The services do not replace medical examination or medical treatment. No medications are prescribed and no certificates of incapacity for work are issued. No promise of healing or success is made. The effectiveness of the therapeutic process depends significantly on the active participation of the patient party.

 

Appointments and Scheduling System

Funke Center operates on an appointment-only basis. Scheduled appointments are reserved exclusively for the patient party. Appointments may take place in person at the practice or as video sessions. Appointment scheduling is carried out by mutual agreement.

 

Appointment Cancellations and Cancellation Fees

Appointments may be cancelled free of charge up to 24 hours before the scheduled start time. For cancellations made less than 24 hours in advance or for non-attendance, a cancellation fee will be charged in accordance with the treatment agreement, as the appointment cannot be reassigned at short notice. There is no entitlement to specific replacement appointments.

 

Fees and Billing

Fees for services are governed exclusively by the individually concluded treatment agreement. Unless otherwise agreed, invoices are due prior to the respective appointment. The obligation to pay remains in effect for short-notice cancellations in accordance with the contractual provisions.The services of the Funke Center are provided exclusively on a self-pay (private payer) basis. Coverage by statutory health insurance is excluded. Billing is carried out directly with the patients. Patients may, where applicable, submit the invoice to their private health insurance or benefit provider for reimbursement.

 

Obligations of Cooperation

The patient party is obliged to provide truthful information (medical history, previous findings, relevant information) and to actively participate in the process. In the case of minor patients, the legal guardians are responsible for implementing agreed measures.

 

Confidentiality and Data Protection

Funke Center is subject to statutory confidentiality obligations. Information will only be disclosed to third parties with explicit written consent or due to legal obligations. The processing of personal and health-related data is carried out in accordance with the separate data protection policy. For remote treatment, GDPR-compliant services are used. The patient party acknowledges that technical risks in electronic communication cannot be completely excluded. Confidentiality obligations remain unaffected.

 

Termination of the Therapeutic Relationship

The therapeutic relationship may be terminated by either party at any time. Services already rendered and appointments not cancelled within the required notice period remain unaffected. Further provisions result from the individual treatment agreement.

 

Liability

Funke Center (Eldin Dzanko) shall be liable only for damages caused by intent or gross negligence. In cases of slight negligence, liability exists only in the event of a breach of essential contractual obligations and is limited to foreseeable, typical damages. Liability for injury to life, body, or health remains unaffected.

 

Final Provisions

The designation “Funke” is used as the name of the Funke Center. The Funke Center is a private entity and not a public institution. Persons, practices, or institutions with the same name are not legally or organizationally affiliated with the Funke Center. German law applies. Should individual provisions of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
